Tonight’s Santa Ana City Council meeting will include an anti-homeless shelter resolution

The regular open meeting of the Santa Ana City Council is scheduled to begin at 5:45 p.m. tonight, Feb. 4, 2020.

The open Council meeting along with meetings of the Housing Authority and Successor Agency will follow a 5 p.m. closed session meeting. The Council meets in the City Council Chambers, 22 Civic Center Plaza, Santa Ana.

The agenda includes the following matters that are not on the consent calendar (routine items considered for approval in a single motion unless pulled for a separate vote):

• Second reading of an ordinance rezoning properties located at 1010 and 1100-B N. Tustin Ave. from professional to a specific development, allowing the Calvary Church Master Plan project that would include a church facility, educational facility and office development.
• Appoint and administer the oath of office to new board and commission members.
• Adopt a resolution supporting National Community Renaissance of California’s submittal of a funding application for the Affordable Housing and Sustainable Communities Grant Program for up to $30 million for the Legacy Square project located at 609 N. Spurgeon St. Authorize the City of Santa Ana to enter into an agreement with National Community Renaissance to use grant funds to construct the surrounding transportation-related improvements for the project.
• Discuss and consider directing staff to restructure or disband one or more existing City Council Committees and make any appointment changes.
• Discuss and consider directing the city manager to request the Police Department and other city departments to fully enforce anti-camping, anti-panhandling and related laws.
• Discuss and consider directing the city manager to recognize Santa Ana residents serving in the military.
• Discuss and consider directing the city manager to develop a homeless work program to provide meaningful work for the homeless.
• Direct the city manager to draft a resolution for the City Council to officially oppose the County of Orange’s construction and operation of any homeless shelters at the proposed Yale Street location and anywhere else in Santa Ana until the County of Orange is operating a proportional amount of shelter beds in the South County Service Planning Area as exists in the Central and North service planning areas.

Supervisor Wagner and DA Spitzer secure funds to end OC’s rape kit backlog

Supervisor Don Wagner and District Attorney Todd Spitzer have committed to working together to clear a 30-year backlog of sexual assault kits

“Because rape kit DNA testing can bring closure to the victims of these horrible crimes, we cannot accept continued delays when the resources are available to us,” said Supervisor Wagner. “The County is committed to ending the backlog, and I am ready to end the backlog. I thank District Attorney Todd Spitzer for his swift action in securing the funds to help make this important public safety measure a reality.”

As part of the solution, District Attorney Spitzer is bringing before the Board of Supervisors a contract with a third-party vendor for Sexual Assault Kit testing services for $612,000; grant money that will assist in clearing about 50% of the gap. The contract is coming to the Board at its meeting scheduled on February 11, 2020. Following Supervisor Wagner’s direction and Board approval, DA Spitzer will revise the contract to include the $400,000 in 14J funding as a solution to complete the entire backlog.

“Clearing the backlog of sexual assault kits has been a priority of mine since I was a County Supervisor, and I have doubled down on that commitment,” said District Attorney Spitzer. “The District Attorney’s Office is fully invested in getting these untested kits tested to provide these victims justice and a safer Orange County. I am pleased Supervisor Wagner requested the additional funds needed to close the backlog gap.”

“Ensuring public safety is a core function of government,” Wagner added. “Both DA Spitzer and I are dedicated to that principle. It does no good to have these rape kits aging on a shelf somewhere. They contain crucial information to solve yesterday’s crimes and to assist law enforcement in the prevention of future crimes.”

Public safety is critical to both Supervisor Wagner and DA Spitzer. Testing a rape kit is only the first step in the rung of justice. If you or a loved one is a victim of sexual assault, please do not shower or bathe as not to remove vital DNA evidence — immediately go to your nearest hospital.

State Senator Umberg endorses Santa Ana Mayor Pulido for O.C. Supervisor

When State Senator Tom Umberg beat his Republican opponent, Janet Nguyen, in the last election it was a major surprise. We supported him as Nguyen had proven to be incredibly corrupt. He was also backed by Santa Ana Mayor Miguel Pulido.

Now Umberg has returned the favor as he has publicly announced that he is endorsing Pulido, who is on his last term as Santa Ana’s Mayor. Pulido is now running for the Orange County Board of Supervisors, in the First District, which is currently represented by former OCDA prosecutor Andrew Do, a Republican.

“I am proud to endorse Mayor Pulido for County Supervisor,” said State Senator Tom Umberg, whose 34th State Senate District overlaps with County Supervisorial District 1. “As Mayor of Santa Ana, Pulido has provided the leadership, vision, and drive for the renaissance and revitalization of Santa Ana over the last two decades. I have enjoyed working with him. He has the experience and knowledge to be extremely effective and impactful for our community on the County Board of Supervisors.”

Do has done a great job of not being partisan in what is ostensibly a non-partisan seat. In fact he had a falling out with Nguyen, who had attacked him repeatedly over the past few years.

Umberg’s announcement was a bit of a surprise in one respect as there are a couple other Democrats in the race including Garden Grove City Councilwoman Kim Bernice Nguyen and Westminster City Councilman Sergio Contreras.

Nguyen in particular is an interesting candidate as she is young and is half Latina and half Vietnamese.

South County cities assure the City of Santa Ana that they will stop dumping the homeless here

The cities of Dana Point, San Clemente and San Juan Capistrano have assured the City of Santa Ana in writing that they have not transported homeless individuals from their cities to Santa Ana and have no plans to do so.

In response to these assurances, the City of Santa Ana today dismissed its federal lawsuit against the three South County cities. The case was dismissed without prejudice, which means that should these cities again propose to transport homeless to Santa Ana, the City of Santa Ana could take legal action.

The County of Orange remains a defendant in the case filed on Jan. 13 in the U.S. District Court for the Central District of California, Southern Division.

The complaint alleges that the County of Orange has established homeless services almost exclusively in Santa Ana, resulting in the City shouldering a greater and inequitable share of the burden of a countywide problem. In addition to the 200-bed Armory winter shelter, the County operates a 450-bed year-round shelter in downtown Santa Ana with plans to replace it with a similar sized shelter also in Santa Ana.

In recent years, the city of Santa Ana has been compelled to spend millions of dollars from its general fund to address health and safety concerns attributable to the homeless population now living here, the complaint states. The City of Santa Ana also operates its own 200-bed shelter for Santa Ana homeless.

Today’s dismissal does not affect a second lawsuit filed Jan. 13 in Orange County Superior Court against Orange County Association for Mental Health, doing business as Mental Health Association of Orange County, and BT Investment Properties, LLC.

In that case, the City of Santa Ana alleges that the operation of the Homeless Multi-Service Center by the Mental Health Association in Santa Ana has resulted in negative impacts to public health, safety and welfare. The City further alleges that the multi-service center is not in compliance with the City’s zoning code.

BT Investment Properties is the owner of the property where the Multi-Service Center is located.

Santa Ana man and four others charged with multiple felonies for preying on vulnerable substance abuse patients

SANTA ANA, Calif. — A joint effort by the Orange County District Attorney’s Office and the California Department of Insurance has shut down an alleged $3.2 million healthcare fraud ring which preyed on vulnerable substance abuse patients in order to bilk an insurance company out of millions.

Steven Lomonaco, 61, of Laguna Beach, Mahyar “Christian” Mohases, 37, of Santa Ana, Robert Williams, 41, of Murrieta, Nicholas Reeves, 42, of Aliso Viejo, and James Frageau, 29, of Temecula have been charged with multiple felony counts including insurance fraud and money laundering in connection with the scheme.

Mohases, Williams, Reeves, and Frageau have each been charged with two counts of committing medical insurance fraud, one count of fraudulent written claim to an insurance company, two counts of money laundering in excess of $150,000, four counts of money laundering, and one enhancement for aggravated white collar crime over $200,000. They each face a maximum sentence of 14 years if convicted on all charges.

Lomonaco has been charged with two counts of committing medical insurance fraud, one count of fraudulent written claim to an insurance company, one count of medical insurance fraud, and one enhancement for aggravated white collar crime over $200,000. He faces a maximum sentence of 8 years 4 months if convicted on all charges.

“Th heartless nature of these crimes are appaling,” said Insurance Commissioner Ricardo Lara. “These suspects trafficked vulnerable substance abuse patients to California just to make a quick buck from the insurance company, with no regard for their lives, health or recovery. Thanks to the efforts of Department of Insurance investigators, and our close work with District Attorney Todd Spitzer’s office, there is one less fraud ring preying on unsuspecting patients.”

Mohases, Frageau, Williams and Reeves are accused of finding patients across the country who were seeking help for substance use recovery and flying them to California to enter treatment at Casa Bella International Inc., which was owned and operated by Lomonaco. In order to obtain payment from the insurance company for these patients, Mohases, Frageau, Williams and Reeves directed employees to fill out policies for the patients using false information.

They are accused of lying on the insurance applications, stating that patients lived in California, when in actuality the addresses were for employees or businesses related to the co-conspirators. Lomonaco paid the other co-conspirators upwards of $10,000 per patient who stayed enrolled in treatment for more than 30 days.

“Sober living homes are valuable resources designed to facilitate recovery and healing for patients battling potentially life-threating addiction issues,” said Orange County District Attorney Todd Spitzer. “Instead of helping these patients, these individuals preyed on extremely susceptible people and exploited their addictions for profit. Working closely with the California Department of Insurance, we are cracking down on these criminals and their predatory operations in order to protect substance abuse patients from unknowingly being trafficked, as protect their loved ones and insurance companies from these unscrupulous operators.”

In order to pay the insurance premiums, the defendants are accused of developing a massive money laundering scheme in which they filtered money through non-profit, StopB4UStart, by providing “donations” from Mohases, Frageau, Williams and Reeves under their corporation, Nationwide Recovery. These “donations” would be cashed out, and the owner of StopB4UStart would receive cashier’s checks in specified amounts based on the information he received from one of the other co-conspirators. More than 800 checks in total were used to pay the insurance premiums on the fraudulent policies.

Mohases was arrested on January 13, 2020 and arraigned on January 14, 2020, he has pled not guilty. He is out on $250,000 bail and is scheduled for a pre-trial on February 5, 2020 in Department C-57.

Reeves was arrested on January 14, 2020 and arraigned on January 15, 2020, he has pled not guilty. He is out on $100,000 bail and is scheduled for a pre-trial on January 22, 2020 in Department C-55. A preliminary hearing for this suspect is scheduled for February 13, 2020 in Department C-55.

Frageau appeared in Court on warrant on January 15, 2020, he was arraigned on January 15, 2020. He is out on $250,000 bail and is scheduled for a continued arraignment on February 7, 2020.

Williams turned himself into Huntington Beach Police Department on January 15, 2020. No arraignment date has been scheduled for him yet.

Lomonaco was arrested on January 16, 2020. He is scheduled to be arraigned January 17, 2020.

The City of Santa Ana sues south O.C. cities and the County over the homeless crisis

The City of Santa Ana filed two lawsuits on Jan. 13 in its continuing efforts to address the impacts of homelessness.

The first seeks to halt the proposed transportation of homeless individuals into Santa Ana by three local cities, among other relief. The second seeks to abate public nuisance conditions at a facility in Santa Ana operated by the Mental Health Association of Orange County.

The legal actions were authorized by a unanimous vote of the Santa Ana City Council during a closed session meeting on Dec. 17.

Case SA CV 20-0069-DOC (DFMx), filed in the U.S. District Court for the Central District of California, Southern Division, names as defendants the County of Orange and the cities of Dana Point, San Clemente and San Juan Capistrano. The complaint alleges violations of the Eighth Amendment prohibition on cruel and unusual punishment and the 14th Amendment’s equal protection and due process clauses.

The City of Santa Ana is seeking monetary damages for its past and future expenditures on homeless resources and related services. The City also is seeking injunctive relief prohibiting the proposed transportation of homeless individuals by the above cities to the National Guard Armory in Santa Ana that is operated by the County for temporary nighttime shelter.

The complaint alleges that the city of San Clemente has closed its temporary homeless shelter and has decided to use the Armory to serve its homeless population. Dana Point and San Juan Capistrano are reported to be sharing in the cost of the transportation of such individuals to the Armory. More generally, Santa Ana urges that these jurisdictions have not equitably participated in relieving the homelessness crisis in Orange County. The complaint seeks to re-focus efforts on a more collaborative approach to the crisis.

The complaint also alleges the County of Orange has established homeless services almost exclusively in Santa Ana. In addition to the 200-bed Armory, the County operates a 400-bed shelter in downtown Santa Ana with plans to replace it with a new 425-bed shelter also in Santa Ana.

The City of Santa Ana operates its own 200-bed homeless shelter for Santa Ana residents.

In recent years, the city of Santa Ana has been compelled to spend millions of dollars from its general fund to address health and safety concerns attributable to the homeless population now living here. That money would otherwise have been spent on providing core services to residents, a deprivation that has subjected residents to cruel and unusual punishment and deprived them of due process of law, the complaint says.

Santa Ana also has the largest Latino population in Orange County, 78 percent of a total population of 341,000, and one of the county’s lowest median household incomes. As a result, the burden of servicing the county’s homeless that has been placed on Santa Ana constitutes a denial of residents’ equal protection under the law, the complaint states.

A hearing on a motion for preliminary injunction in the federal case is scheduled for Feb. 4 at 8 a.m. in U.S. District Court in Santa Ana.

The second case, filed in Orange County Superior Court, names as defendants the Orange County Association for Mental Health, doing business as Mental Health Association of Orange County, and BT Investment Properties, LLC, which is the owner of the property in question.

In this case, Santa Ana alleges that the operation of the Homeless Multi-Service Center by the Mental Health Association has resulted in negative impacts to public health, safety and welfare. The Santa Ana Police Department received more than 249 calls for service at the location between May 1, 2017, and Jan. 9, 2020, according to the complaint.

The City further alleges that the multi-service center is not in compliance with the City’s zoning code.
